Terms of Service

These Terms of Service ("Terms") form an agreement between DeVoy Marketing ("DeVoy Marketing," "we," "us," or "our") and the person or business purchasing services ("Client," "you," or "your").

By completing checkout, submitting payment, accepting these Terms during checkout, or allowing DeVoy Marketing to begin work, you agree to these Terms.

1. Website Design Build

The Barbershop Website Design Build is a streamlined website service based on one of DeVoy Marketing's available barbershop website designs.

The Website Design Build generally includes:

• A professionally prepared barbershop website
• Selection from the available website design options
• Customization using your business information and branding
• Placement of approved photos, services, pricing, hours, and business details
• Mobile-responsive website formatting
• Connection to your existing booking system or booking link
• Phone, booking, and social media links
• Domain setup or connection when applicable
• Website launch and initial technical setup
• Up to three pre-launch revision rounds

This offer is intended to provide a fast, professionally prepared website using DeVoy Marketing's established design system. It is not a fully custom website design engagement unless separately agreed in writing.

2. Website Content and Client Information

You are responsible for providing complete and accurate information needed to build the website. This may include:

• Business name and contact information
• Services and pricing
• Business hours
• Booking links
• Social media links
• Logos and brand information
• Photos and other media
• Staff or barber information
• Any other information reasonably needed for the website

Delays in providing requested information, access, approvals, or content may delay the website build or launch.

You represent that you have the legal right to use any photos, logos, text, trademarks, business information, or other materials you provide to DeVoy Marketing.

3. Revisions

The Website Design Build includes up to three pre-launch revision rounds.

A revision round means one reasonably consolidated set of requested changes submitted for review at one time.

Revisions are intended for adjustments to the selected website design, existing content, images, business details, links, and similar items.

Requests that substantially change the website structure, selected design, page count, functionality, or original project scope may require additional fees.

4. Managed Website Care

The first 30 days of Managed Website Care are included with the Website Design Build.

After the included first 30 days, Managed Website Care is billed at $69 per month.

Managed Website Care may include:

• Website hosting
• SSL certificate upkeep
• Website backups
• Basic website security maintenance
• WordPress and plugin maintenance
• Technical website upkeep
• Domain registration, renewal, or management when handled by DeVoy Marketing
• Maintenance of booking, phone, and contact links
• Reasonable minor content updates to the existing website

Minor content updates may include changes such as business hours, staff information, existing services, pricing, phone numbers, email addresses, booking links, photos, or corrections to existing website content.

5. Work Not Included in Managed Website Care

Managed Website Care is an ongoing maintenance service and does not include unlimited website development.

Unless separately agreed, Managed Website Care does not include:

• New website pages
• Major redesigns
• Large layout changes
• Custom website functionality
• Custom software development
• Large copywriting projects
• Rebranding projects
• Search engine optimization services
• Google Business Profile management
• Paid advertising management
• Marketing campaigns
• Third-party software or subscription fees

Work outside the Managed Website Care scope may be quoted and billed separately.

6. Initial Six-Month Service Term

The Barbershop Website Design Build is offered at a reduced upfront acquisition price in connection with an initial six-month Managed Website Care term.

The initial service term consists of:

• The first 30 days of Managed Website Care included at no additional charge; and
• Five monthly Managed Website Care payments of $69 each.

7. Billing Authorization

By completing checkout, you authorize DeVoy Marketing and its payment processor to charge the payment method provided for:

• The $49.99 Website Design Build payment due at checkout
• The five required $69 monthly Managed Website Care payments during the initial service term
• Ongoing $69 monthly Managed Website Care payments after the initial term until canceled

The first $69 Managed Website Care payment is scheduled approximately 30 days after the initial website purchase.

Recurring payments are processed through a third-party payment provider such as Stripe.

8. Month-to-Month Service After the Initial Term

After completion of the initial six-month term, Managed Website Care automatically continues on a month-to-month basis at $69 per month unless canceled.

After the initial term has been completed, you may request cancellation before the next scheduled billing date to prevent future monthly charges.

9. Cancellation During the Initial Term

A request to stop using the website or Managed Website Care during the initial six-month term does not automatically eliminate payment obligations already agreed to for that initial term.

Unless DeVoy Marketing agrees otherwise in writing or applicable law requires otherwise, the five $69 Managed Website Care payments associated with the initial term remain due.

10. Failed or Late Payments

If a scheduled payment fails, DeVoy Marketing may attempt to process the payment again using the payment method on file.

If an account becomes past due, DeVoy Marketing may pause website maintenance, support, hosting, or other services until the account is brought current.

You remain responsible for amounts due under the agreed initial service term.

11. Refunds

Because the Website Design Build involves customized work, setup, account configuration, and production time, payments are generally non-refundable once work has begun, except where required by law or where DeVoy Marketing agrees otherwise in writing.

Recurring Managed Website Care payments are generally non-refundable once the applicable billing period has begun.

Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived.

12. Domain Registration and Management

When DeVoy Marketing assists with registering or managing a domain for the Client, the domain is intended to be used for the Client's business.

DeVoy Marketing may manage domain registration, DNS settings, and renewals while Managed Website Care remains active.

If the service relationship ends and the Client's account is in good standing, DeVoy Marketing will reasonably cooperate with transferring management of the domain to the Client or another provider.

After transfer or termination of Managed Website Care, the Client is responsible for future domain renewals, hosting, DNS management, and related technical services unless another arrangement is made.

13. Website Ownership

Upon payment of all amounts due and subject to any third-party software licenses, the Client may use the completed website for the Client's business.

DeVoy Marketing retains ownership of its general design systems, reusable templates, development methods, processes, tools, code libraries, and other materials created independently of the Client's project.

Third-party software, themes, plugins, booking platforms, fonts, images, or other licensed materials remain subject to the terms of their respective owners.

14. Third-Party Services

The website may connect to or rely on third-party services such as Stripe, booking platforms, social media platforms, domain registrars, hosting providers, analytics tools, email providers, or WordPress plugins.

DeVoy Marketing does not control third-party services and cannot guarantee that those services will remain available, unchanged, or free from interruptions.

Fees charged directly by third-party providers are not included unless specifically stated otherwise.

15. Booking Systems

DeVoy Marketing may connect the website to the Client's existing booking platform or booking link.

The Client remains responsible for maintaining any separate account, subscription, fees, availability settings, services, staff schedules, or appointment information inside the third-party booking platform.

16. Delivery Estimates

DeVoy Marketing may provide estimated turnaround times for website builds, revisions, or updates.

Delivery estimates depend on timely Client responses, access, approvals, content, third-party systems, and technical conditions. Unless expressly agreed in writing as a guarantee, delivery dates are estimates rather than fixed deadlines.

17. Client Review and Approval

The Client is responsible for reviewing the website before launch and notifying DeVoy Marketing of errors or requested revisions.

Client approval to launch will be treated as confirmation that the Client has reviewed and accepted the website in its then-current form.

18. No Guaranteed Business Results

The Website Design Build and Managed Website Care are website development and maintenance services.

DeVoy Marketing does not guarantee a specific number of website visitors, appointments, clients, leads, revenue, search rankings, or other business results from this service.

19. Suspension or Termination

DeVoy Marketing may suspend or terminate services for material nonpayment, unlawful use, abusive conduct, fraud, security risks, or material violation of these Terms.

Termination does not eliminate payment obligations that accrued before termination or amounts due under the agreed initial service term, except where required by law.

20. Limitation of Liability

To the extent permitted by law, DeVoy Marketing is not responsible for indirect, incidental, special, or consequential losses arising from use of the website or services, including lost profits, lost business opportunities, lost appointments, or losses caused by third-party platforms or outages.

DeVoy Marketing's total liability relating to this service will not exceed the amount paid by the Client to DeVoy Marketing for the affected service during the six months immediately preceding the event giving rise to the claim, except where applicable law does not allow such a limitation.

21. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law is required to apply.

22. Changes to These Terms

DeVoy Marketing may update these Terms from time to time as services, pricing, or business practices change.

Changes to these Terms will not retroactively alter a Client's existing initial payment obligations unless the Client agrees to the change or applicable law requires it.

23. Entire Agreement

These Terms, together with the applicable checkout information, written proposal, invoice, or other written service details provided by DeVoy Marketing, form the agreement governing this service.

If a separately signed written agreement conflicts with these Terms, the separately signed written agreement controls for the conflicting provision.

These Terms currently apply to the DeVoy Marketing Barbershop Website Design Build and Managed Website Care offer. Additional DeVoy Marketing services may be added to these Terms in the future.
